Terms of Service

Important: These terms of service are a draft and should be reviewed by a qualified legal professional before being relied upon.

1. Acceptance of Terms

By downloading, installing, or using the Peak Pull mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Peak Pull is a strength measurement application designed for personal trainers. The App connects to Bluetooth Low Energy (BLE) scales to measure clients' peak force during exercises, track progress, detect left/right muscle imbalances, and manage client data.

3. Account Registration

To use the App, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscription and Billing

The App offers the following tiers:

  • Free — Limited number of clients and exercises per client, with basic measurement features
  • Pro — Unlimited clients and exercises, advanced analytics, data export, cloud sync, and priority support

Pro subscriptions are billed through your app store (Apple App Store or Google Play). Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period. Cancellation does not entitle you to a refund for the current billing period.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms
  • Attempt to reverse-engineer, decompile, or disassemble the App
  • Interfere with or disrupt the App's functionality or servers
  • Upload malicious code or attempt to gain unauthorized access
  • Use the App to store data that violates third-party rights

6. Intellectual Property

The App, including its design, code, features, and content, is owned by Peak Pull and protected by intellectual property laws. You retain ownership of the data you enter into the App (client data, measurements, notes).

7. Client Data Responsibility

As a personal trainer using the App, you acknowledge that:

  • You are responsible for obtaining appropriate consent from your clients before entering their personal data and measurements into the App
  • You must comply with applicable data protection laws regarding your clients' data
  • You are responsible for the accuracy of client data you enter
  • You should inform your clients about how their data is being stored and used

8. BLE Device Compatibility

The App is designed to work with Bluetooth Low Energy (BLE) compatible scales. We do not manufacture, sell, or warranty any third-party hardware. Measurement accuracy depends on the quality and calibration of your BLE scale. We are not responsible for inaccurate readings from third-party devices.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. The App is not a medical device and should not be used for medical diagnosis or treatment decisions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEAK PULL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

11. Indemnification

You agree to indemnify and hold harmless Peak Pull from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms. Upon termination, you may request export of your data within 30 days. After that period, your data may be deleted.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Brazil, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the updated Terms.
